You agree that the owners of this web site exclusively reserve the right and may, at any time and without notice and any liability to you, modify or discontinue this web site and its services or delete the data you provide, whether temporarily or permanently. We shall have no responsibility or liability for the timeliness, deletion, failure to store, inaccuracy, or improper delivery of any data or information.

By purchasing and towing a trailer, you assume ALL risk and responsability for the trailer and towing dangers.

11. Reservation of Rights.

We reserve all of our rights, including but not limited to any and all copyrights, trademarks, patents, trade secrets, and any other proprietary right that we may have in our web site, its content, and the goods and services that may be provided. The use of our rights and property requires our prior written consent. We are not providing you with any implied or express licenses or rights by making services available to you and you will have no rights to make any commercial uses of our web site or service without our prior written consent. Furthermore, by submitting any form of media, including but not limited to, pictures, videos, reviews, etc. to us by means of mail, email, Facebook and other social media, etc., you grant us rights to use said media to promote our products, unless otherwise stated.

12. Applicable Law.

You agree that this {:Terms of Use:} and any dispute arising out of your use of this web site or our products or services shall be governed by and construed in accordance with local laws where the headquarters of the owner of this web site is located, without regard to its conflict of law provisions. By registering or using this web site and service you consent and submit to the exclusive jurisdiction and venue of the county or city where the headquarters of the owner of this web site is located

13. Cancellations & Refunds.

All sales are final upon purchase. Terms are applicable on ALL sales, including but not limited to phone orders, email orders, and online orders. Cancellation/return requests may be made up to 30 days from the confirmed tracking delivery date. There will be a $250 cancellation fee on all trailer orders, plus 3% for credit card fees when applicable. If the trailer has already been crated when the order is canceled, there will be an additional $250 uncrating fee. There will be up to a 10% cancellation/restocking fee on all parts and accessories orders, plus 3% for credit card fees when applicable. Items must be returned in new condition for a refund. There will be NO REFUNDS on shipping and handling charges, including crating fee of $250 for trailers. Refunds will be based on actually shipping/handling/crating charges, NOT flat rate fees. All returns must be approved, and we reserve the right to refuse any returns.

14. Warranty for trailers and parts.

Individual parts are warranted by the original manufacturer with individual, varied warranties. Please contact the original manufacturer for warranty information on an individual part. Other than individual part warranties, the trailer is sold "As Is". We encourage you, the customer, to pick the unit up at our facility to ensure that it meets your specific standards. We are not responsible for cosmetic chips, cracks, or dents. We are not responsible for structural damages that occur from accidents, reckless behavior, overloading, neglect, or other issues that are a result of user error.

15. Sales & Sale Items.

Any trailer purchased at a discounted price due to sales, promotions, discounts, or any other method, must be picked up or able to accept shipment within 30 days of the trailer being completed. Sale prices will not be honored after 30 days from the completion of the trailer. All orders must be picked up within 30 days of completion or they will be subject to current retail pricing. Any cancellations due to non delivery are subject to terms and conditions outlined in section 13, Cancellations & Refunds. Sales cannot be combined with any other sale or offer. Sales codes only apply to the full retail price of a trailer.

16. Receiving a shipped trailer and shipping rates

Shipping damage is rare, but it is extremely important to follow these instructions when receiving your trailer. When the trailer is delivered, please check the crate very carefully for any damage. If any damage is seen, or if the "DO NOT STACK" sign is crushed or tampered with, notify the driver and make a note of the damage on the paperwork before signing and take pictures if possible. Crate damage not reported to the driver and marked on the BOL will not be eligible for reimbursement. Uncrate the unit and inspect it carefully. If there is in fact damage to the trailer, immediately call the carrier and speak with someone about filing a damage claim. Kompact Kamp takes great pride and care in crating our trailers for shipping and will NOT be responsible for any damage caused by the shipping carrier or any negligence by the carrier during transit. Damaged or missing parts must be reported within 7 days of receiving your trailer. Residential delivery appointments must be made promptly as the carrier can charge storage fees for crates that are not able to be delivered in a few days. Any additional fees for storage, added accessorials, inside delivery, making a driver wait, etc. are the responsibility of the customer.

Flat Rate Shipping prices are only applicable to 48 contiguous US states only. Residential delivery price includes liftgate truck and delivery appointment. Business/Terminal delivery price is only valid for delivery to a business address that receives freight shipments with a loading dock or forklift, or delivery to the closest shipping terminal for pick up. Delivery to airports, military bases, or any other destination requiring security or additional clearances is subject to surcharges. All flat rate prices are for economy transit with a carrier chosen by the seller (Kompact Kamp). The closest terminal delivery locations are chosen by the seller (Kompact Kamp) and determined according to the carriers within the seller's shipping program. Custom shipping rates may be available by contacting Kompact Kamp for a custom shipping quote. Crate specs for shipping: 65" x 45" x 42". Approximately 500lbs.

17. Miscellaneous Information.

(i) In the event that this {:Terms of Use:} conflicts with any law under which any provision may be held invalid by a court with jurisdiction over the parties, such provision will be interpreted to reflect the original intentions of the parties in accordance with applicable law, and the remainder of this {:Terms of Use:} will remain valid and intact; (ii) The failure of either party to assert any right under this {:Terms of Use:} shall not be considered a waiver of any that partys right and that right will remain in full force and effect; (iii) You agree that without regard to any statue or contrary law that any claim or cause arising out of this web site or its services must be filed within one (1) year after such claim or cause arose or the claim shall be forever barred; (iv) We may assign our rights and obligations under this {:Terms of Use:} and we shall be relieved of any further obligation.

19. Branded Merchandise Terms:

Usually, it takes 3–7 days to fulfill an order, after which it’s shipped out. The shipping time depends on your location. Due to Covid 19, our fulfillment times may be longer than usual and may continue to increase until things get back to normal. We're seeing delays in our supply chain, including distributors and shipping carriers as the entire industry is grappling with challenges.

Shipping

We work with an on-demand order fulfillment company. All branded merchandise items will be fulfilled and shipped by a third-party company. Shipping times will vary depending on delivery location and shipping carriers.
